A new injunction filed by Apple is seeking the sales ban of all of Samsung's smartphones and tablets as part of the two companies' patent fight.

Apple's legal fight with Samsung has entered yet another round today. As reported by News.com, Apple has now filed a new injunction that would ban the sale of all of Samsung's smartphones and tablets, including the Samsung Galaxy Tab 10.1 and 7, throughout the countries of the European Union. The smartphones included in Apple's injunction include the Galaxy Ace, the Galaxy S, and the Galaxy S II. All of these devices uses Google's Android operating system.

Apple filed the new injunction at a court a district court in The Hague. If the court grants the injunction, Apple wants Samsung to send a letter to retailers and distributors to remove its smartphones and tablets from stores within 14 days. For its part, Samsung has issued a statement saying, "Samsung will continue to actively defend and protect our intellectual property and to ensure our continued innovation and growth in the mobile communication business."

Apple has claimed that Samsung's smartphone and tablet designs and their user interfaces violate Apple's patents for devices like the iPhone and iPad. Earlier in August, a court in Germany banned the sale of the Samsung Galaxy Tab 10.1 through all of Europe except the Netherlands. Earlier this week, that ban was overturned by another court decision saying that the German court ruling should apply only to Germany and not to the rest of Europe. The Galaxy Tab 10.1 is still banned for sale in Australia thanks to a similar injunction filed by Apple earlier this summer and agreed to by a court in that country.

Apple has gone way pass their limits now. Enough is enough. First, fake evidence in Germany court to ban Galaxy Tab, now trying to ban whole Samsung smartphones and tablets. What's next? They try to ban Samsung on whole earth? -_-

That's interesting and something I'd never heard/read before. I would be grateful if you could explain what you mean by that part about Apple faking evidence.

Well, fake maybe a harsh word, but I should called it flawed instead, see this. Another one. I can give you more articles if you want.

And just in today, this and this.

Of course, we sitting here cannot prove it, but I can certainly tell you that Apple, these days, only know how to sue.

By the way, I was in no way implying Apple was innocent. I fucking hate them. The only tech company that I can think of that rapes their customers worse than Apple is HP.

Apple can go to hell, I don't care what's their reasoning, what they're doing is just plain stupid. What? They're literally trying to eliminate the competition? Gimme a break! All they offer are over-hyped and over-priced products then whine people choose different/better products.

I used to like Apple products at some point, but now I reached the point where I utterly despise the whole brand because of their underhanded methods.

seems to me samsung must be making some good products that wormy is that afraid. they trying to get it ban everywhere but the usa.

time to finally nuke wormy. at least with droid different companies can make their own phones for what ever phone company (usa) i know the world has universal networks.

And Apple copied Chinese P88 tablet to make iPad. Those claiming otherwise don't know that they had announced the P88 tablet, with pictures, months before iPad announced iPad.

The grid icons that Apple claims to be it self's was invented by PalmOS guys.

You think Apple has invented everything by themselves?

In the time where Android is on rise on both Smartphones and Tablets, soon it will overtake Apple in smartphones, Apple is suing most of the smartphone companies. Motorolla, Samsung, HTC, etc. all have been sued by Apple for certain things that are a standard before Apple started using them. They think they can't do whatever they want just by claiming it all.

Apple granted injunction halting EU Galaxy phone sales

A Dutch court has granted a preliminary injunction, filed by Apple, which bans the sale of some Samsung smartphones in the European Union. While the injunction does not relate to the Galaxy Tab line of Samsung tablets, it does prevent the sale of the Galaxy S, Galaxy S II and Galaxy Ace Android devices. The decision was made after the hearing held on August 10 and 11.

As FOSS Patents points out, the injunction only applies to countries where one specific European software patent applies. It also does not restrict Samsung's Korean parent company from distributing devices outside The Netherlands, however this will be difficult due to Samsung using the country as a hub for shipments to the rest of Europe.

The decision will come into effect in seven weeks; however Samsung will no doubt appeal this injunction. Also worthy of note is that FOSS Patents mentions that "at a first look it seems that the court has a skeptical perspective on a couple of the software patents asserted by Apple."

This is the second preliminary injunction that has been granted in favour of Apple and against Samsung in the EU – the first being the ban on the Galaxy Tab 10.1 granted by a German court. Since then, the ban has been temporarily lifted as evidence has been reportedly falsified by Apple and Samsung has claimed that the iPad design could be derived from the film 2001: A Space Odyssey.

This article misses a lot of important details. All of the claims (including all the design and functionality ones) have been dismissed except for using swipe gestures for switching to the next photo in the gallery application. All Samsung and/or Google has to do is make changes to the gallery app and they will be able to continue selling these phones in the EU. If anything this seems like more of a victory for Samsung since it only applies to an app on the phone which is easily changeable vs. the phone design itself.
