Apple sues Samsung for 'copying' smartphones, tablets

Apple is continuing its crusade against competitors that it believes are ripping off its ideas. The company filed a lawsuit against Samsung on Monday, alleging that the electronics giant violated Apple's intellectual property in its Android-powered devices like the Galaxy Tab, Nexus S, and Epic 4G.

"Rather than innovate and develop its own technology and a unique Samsung style for its smart phone products and computer tablets, Samsung chose to copy Apple's technology, user interface and innovative style in these infringing products," reads the complaint seen by the Wall Street Journal. (The lawsuit doesn't yet appear to be in PACER, and Apple did not respond to our request for a copy of the complaint.)

The Journal's writeup is short on details, but we believe Apple's complaint is referring to Samsung's "TouchWiz" user interface, which (among other things) lays out the device's apps in a grid of icons. The app drawer is particularly Apple-like, and a brief discussion about TouchWiz among the Ars staff left us in agreement that TouchWiz is toeing the line in its mimicking of iOS.

Apple's language when describing Samsung's alleged follies is reminiscent of the language used when Apple sued Nokia for patent infringement. In December of 2009, Apple said that Nokia had "demonstrated its willingness to copy Apple's iPhone ideas" when creating its own devices. More recently, Apple went after Amazon for using the term "App Store," arguing that Amazon is riding on the tails of Apple's success.

There's no doubt that Apple is applying the same logic to Samsung's own UI choices. The iPhone (and increasingly the iPad) are Apple's headline products now, and the company has shown a continued willingness to sue competitors who use what it considers to be its own innovations.

A product or a thing or any working piece of object ,

all starts from an IDEA ,

which is then implemented and executed and brought to form and life by who so ever can / or has the ability and the resources to do so ..

Samsung fiercely reply to Apple lawsuit for copying design

Yesterday Neowin reported that Apple had filed a lawsuit against Samsung for apparent blatant copying of the iPhone and iPad in Samsung's devices despite the two having a good working relationship with Samsung providing Apple with components for the company's iOS devices.

Today Samsung have fiercely responded to the accusation as a Samsung spokesman said "Samsung will respond actively to this legal action taken against us through appropriate legal measures to protect our intellectual property,"

It would appear that Samsung are annoyed by the accusation, so much so that they themselves are planning to take legal action against Apple as Chung Jae-woong, Samsung's spokesman later said "We think Apple has violated our patents in communications standards. We are considering a counterclaim."

It seems as if Samsung are stunned to see such a lawsuit against them and don't plan on making the lawsuit easy for Apple to uphold. "Apple is one of our key buyers of semiconductors and display panels. However, we have no choice but respond strongly this time."

On top of the accusations for being in breach of violating some of Cupertino's core technology patents Apple is accusing Samsung of violating its design patents, which in essence patents how the product looks. An Apple spokesman told the Wall Street Journal "It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging. This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas,"

It's an open debate whether company's should be able to patent such simple design ideas such as rounded corners on the phone and it remains to be seen who will come out of this lawsuit the victor. The question could be raised, how hard will it affect the Apple-Samsung relationship if at all?

Opposite way

Well them suing practices is only way to keep innovations protected and have market stimulated for such. Apple is very brand important as it brought load of innovative products and is intending to do that by claiming what in theory is correct stance, but at the end of a day copies are getting better so next step- law suits... Dont like the fact, that technology gets treated is such business module, but no-one is saint and for big guys- way to make them self more publicity to!

You think that this design of Apple is original? There are some accusations by top mobile reviewers that Apple themselves took the grid thingy from Palm OS and physical shape from LG.

And yea, Samsung makes the chips for Apple devices.
