Sony to inspect PlayStation hacker's hard drive

PlayStation 3 jailbreaker George Hotz must allow console-maker Sony to comb through his computer's hard drive and retrieve information "that relates to the hacking of the PlayStation," a federal judge ruled Thursday.

US District Judge Susan Illston's ruled from the bench in Sony's ongoing legal action against the New Jersey hacker, who goes by GeoHot. The lawsuit is in connection to the 21-year-old being the first to fully hack the 4-year-old console, a jailbreak allowing it to play pirated and homebrewed games.

Hotz posted the code on his website last month, and put a how-to video on YouTube. That landed him in court here on Digital Millennium Copyright Act civil allegations. Among other things, Sony accuses him of trafficking in devices that circumvent controls meant to protect copyrighted works.

In the Thursday hearing, Hotz' attorney, Stewart Kellar, objected to the judge's bench order, saying Sony would be able to "observe" the contents of all his client's files.

"That's the breaks," Illston said.

Hotz has already removed the YouTube video and the code from his website to comport with the judge's earlier orders.

The judge had originally ruled weeks ago that Hotz must surrender all of his computer gear to Sony. But Kellar asked for reconsideration, and a hearing was hastily called Thursday

Illston informed Kellar that it was routine for the entire contents of computers to be searched in a bid to isolate what is being sought, as in child pornography prosecutions.

"Your honor, we're certainly not dealing with child pornography in this issue," Kellar replied.

George Hotz Moments later, the judge responded:

"Here, I find probable cause that your client has got these things on his computer," she said. "It's a problem when more than one thing is kept on the computer. I'll make sure the order is and will be that Sony is only entitled to isolate … the information on the computer that relates to the hacking of the PlayStation."

The DMCA makes it either a civil or criminal offense to traffic in wares meant to circumvent devices protecting copyrighted works. Performing a similar hack on a mobile phone is lawful.

Sony's attorney, James Gilliland, was quick to point out to Illston that the mobile phone is not at issue here. "The conduct Mr. Hotz has engaged in is still covered by the DMCA," he said.

The judge also backed off on an order that Hotz "retrieve" the code from anybody who he may have forwarded it to.

"It's information. It can't be retrieved. It's just not practical," Illston said. "What would they do, Xerox it and mail it back? "

Illston said she changed her mind because she was not clearly aware of the details in her earlier order.

"This kind of got away from me and I apologize for that," she said from the bench.

The judge ordered Sony and Kellar to confer with each other on the parameters of where and when Hotz would allow Sony to sift through his computer. She also ordered him not to delete or modify any files connected to the jailbreak.

Meanwhile, Sony is threatening to sue (PDF) anybody posting the code, even though Sony accidentally tweeted it earlier this week.

Sony's attorney, Gilliland, said the Japanese console maker has been sending out an undisclosed number of DMCA "takedown" notices to websites demanding the code's removal.

Sony is also asking Judge Illston to order Google to surrender the IP addresses [.pdf] and other identifying information of those who have viewed or commented about the jailbreak video on Hotz' private YouTube page. The game maker is also demanding that Twitter provide the identities of a host of hackers who first unveiled a limited version of the hack in December.

A hearing on that is scheduled next month. Sony is seeking unspecified damages.

My advice to all the PS3 users. Start trolling the jailbreak code. :P

Okay so they deleted the thing first.. now SONY wants to go through his things and see about it? at least he didn't get his things taken away... Now if they could just protect his personal privacy.. I do agree that in fact... Jail-breaking the console .. is the same as the Phones.. I mean they are ruining and trying to limit the devices only so they can commercialize on it one thing at a time and squeeze people who otherwise do not know any better for every dime they can.. then release features..as time progresses... If you know what your doing then you can actually enable these things on your own.. without the assistance of some corporation..Its like a free-ware versus and paid-ware.. except this time around the individual is empowered to do so themselves.. They don't have to sign a contract in blood with SONY to test and release their own games.. in which they create ... and if used by nefarious means then so be it...

We live in a time where what we pull out of the box.. was overpriced to begin with.. full of advertisements and missing features and advanced settings so that someone can suck us dry of every penny we can.. The problem with that is that we are smareter than that.. We must have more than that.. When I unwrap my computer and boot it up .. The last thing I want to see if something setup for a little girl with a credit card.. I want to remove the garbage.. I want to optimize the system and clear the way for it being a real tool.. I don't want all of the billboard crap across my screen or tagged in the corner of every window.. I want something that will operate and appears the way I want it to.. When I purchase a HD I don't want 2.67 GB of the hard drive full of crapware which is full of spyware and adware ruining the space I have available to use.. I want the space I paid for.. and I want it full of thing that I want.. I want to be able to install the programs I want .. modify the thing the way I want... its mine.. this is the product I purchased.. I did not wake up this morning and say, 'Hey .. I think I want to go buy a wad of scrolling ads and limitation imposed by corporate planning...I think I want to walk around like an airhead caught up in the hype and BS of the marketplace... and destroy myself with credit card debt and compulsive purchases.. so that I can continue to cyclically do so...', nor did I say that I want packages of the world worst software ( because they could sign an agreement with a distributor to try to save a failing piece of crap ).. Nor do I want some corporation jacked in to my shit telling me what I am going to do and what I am not with a something I purchased to own outright... It like flashing back to the days of preteen adolescence when your mom decided to loose her remind and stand over your shoulder .. riding your into the ground.. beating you over the head saying you can do that when its well within normal parameters and if you don't you die as a person.. It is bullshit in the end.. Their greed should not limit the freedoms of the country.. it should limit someone like GeoHot who is capable of doing more than a corporation with their billions paid in salaries to protect themselves... and their properties correctly ( negligent on their part )... For years it is about opening doors and broadening the scope of capabilities for programs and users alike to become smarter and better connected... It is not supposed to be allowed to be turned into he same nightmare over and over again.. Where do we learn from our mistakes? What will it take to make decisions protecting this right.. and why will we continue to allow someone to tell us we cannot expand our capabilities and knowledge because some greedy pissed of idiot is going to take everything they have to go after someone.. because they are afraid of saving face.. made a laughing stock of.. and the fact that they do so poorly at the job of protecting themselves and intellectual property that its cracked in a day.. when someone sits down to do it.. I mean I deny ass-wrangling rights at that point...

IF they in fact want to increase their revenue.. open the PS3 to user modification... give it more capabilities than other consoles and allow this freedom in which we all look for... IF they in fact want to protect these properties and games.. then I would suggest they innovate a new scheme to do so as this has been shown to be taken down.. Something you cannot ignore.. Give back the ability to install Linux.. You don't have to issue support.. just give them ability.. Most people don't call support anyway because they are incompetent anyway....( haver to give some credit though ) We can do it ourselves...

We are allowing corporations to violate the right of civilians... They are making us pay two and three times for something we should have only paid once for.. and they are using the dollar to limit us and our capabilities..they are limiting our creativity and trying to take our freedoms... They are many other ways for corporations to protect these sorts of things.. KEEP THE CORPORATE RULES FOR CORPORATIONS... do not expand these elements to take over our lives and enslave us to it... Do not support it... I mean what next .. You look up and there is no government or its only a background entity... to the businesses who can use this to walk around stealing from everyone in areas that have no connection?

The creation of the hack does not imply the abilities to pirate or otherwise wrangle games and intellectual property already in existence but expands the usage of an otherwise limited console.. The US government even used these things.. UNTIL.. they changed the firmware.. which was one of the first problems I remember concerning this console... We need consultants and people who know what they are doing without the financial affiliation...we need people making these decision with the knowledge that will enable them to make proper decisions.. With considerations and acknowledgment of a realization of the mistakes that can be made... in either direction..there is no one-sided street here... Its a very dynamic forum.. of which we live our lives and the very thing this country stands for and what we strive for as a people is being exploited...
