3 Strikes Coming To The United States Via The Back Door?

From this year’s State of the Net Conference, Alex Curtis from Public Knowledge is reporting on a panel entitled: “Copyright Strikes: When Has a Pirate Graduated to Internet Exile?”

While the panel consisted of representatives from IFPI, Center for Democracy & Technology, Computer and Communications Industry Association and the UK government. Notably missing were representatives from the RIAA and MPAA. They were present, says Curtis, but unusually observing quietly from the audience.

Those on the panel in favor of the “graduated response” are said not to have shied away from their positions.

In a discussion on whether the punishment fits the alleged crime, Shira Perlmutter, Executive Vice-President of Global Legal Policy at IFPI said sending infringement notices just isn’t enough, adding that termination of a user’s Internet account, however, is preferable to suing them.

When asked if “3 strikes” should come to the United States, Perlmutter pointed to the existence of the DMCA (disabling access to illicit content is already provided for under the legislation) and noted that there are “many conversations going on at different levels.”

Writing on the apparent disinterest in “3 Strikes” shown by the MPAA and RIAA by their lack of participation on a panel such as this, Curtis goes on to list several filings to the FCC which contain pro-disconnection statements by the groups, indicating that they are indeed asking the government to take action. Indeed, Curtis feels that their low profile at this panel points to the existence of “back room deals” already underway and aimed at putting their plans for the US into action.

Given that the music industry has all but given up on their strategy of suing new individuals for file-sharing (the MPAA never really started) and that IFPI has put its full-blown support behind proposed “3 Strikes” legislation in several different countries (even now carefully escalating a campaign in Sweden), it seems likely that at some point the United States will follow.

If it doesn’t come via a government mandate, says Curtis, it could come via a private arrangement between your ISP and content providers. And when you think about it, with all previous plans to end online piracy having failed, there’s very little for the copyright holders left to try. At this stage there can be little doubt that Big Media wants “3 Strikes” to become the global standard.

What these organizations are ignoring are the already existing laws in the United States regarding Copyright infringement. This includes the profiteering from the reproduction of works which hold a legal and binding copyright ( which is maintained ). So regardless of what mafia/mob standard that Big Media's representatives try to pass under the table.. and negate Federal Laws.. These actions will undoubtedly come under siege by the US government, with as much force as 'Copyright Infringement'. Where it would fall under United States Law.. I doubt seriously, if in fact a law put into effect begin to limit the freedom of speech, censorship, and access to information ( which would have to be done by a third party organization ) that any action will be allowed withing our borders. You violate the rights of innocent people, unjustly criminalize, and defile the very Constitution the country was built upon by going with a 'martial law' view on action on behalf of media companies who can't seem to keep 'Big Media' in their pants to begin with..( or even protect their assets.. in other words )

HOWEVER, the fact still remains that if in fact someone is sharing and distributing a currently copyrighted work.. They can in fact receive a Felony charge for each account and incur jail time. These thing are usually overseen by the FBI. Especially since it falls under Federal Law and no jurisdiction ( unless services rendered in aide ) is held by any other authority. That means the IS does not hold the power of the FBI, that means the other organizations do not reserve that power either... That means the FBI, are responsible for this area and the investigation and monitoring of something large enough to truly impact 'Life as we know it'.. Evading the controlling authorities and going behind their backs with money and deals, is usurping the government assertion of power in these areas. I mean do you let your friends come into your home and tell you what your going to do with it? Regardless of the fraud, bribery... and who knows what else is going to be done by these 'cowboys'... I am sure that if ANYTHING is to take place the proper measures, and tactics will be used. This however and the reckless destruction and negative representation and impact this neanderthalic organization is getting away with openly... by even presenting these ideas in this form... With no positive sense of self reform or the industry and change to accompany TODAY'S customer in a growing digital world... ( Mind you its not just the customer but businesses as well ) Oh and BTW their are legal statutes which allow an individual to break legal contract when that contracts change.. without their new expressed agreement to said change and contract.. while under agreement in original contract....WHEN those changes infringe upon legal rights.. ( which almost like being caught red handed as a company ) so essentially people can drop contracts, service agreements, .. and service.. From this I am sure other services will grow as well..

Greed, militant control, and force was what triggered the Boston Tea Party... against Britain.. Absolute power without proper techniques to ensure just and wit action, which will not negatively impact the industry even more, is not acceptable...

I say it a thousand times.. as I am sure a lot of people do.. and I am coming from a place that has nothing to do with being able to download what I want.. I WILL NEVER UNDERSTAND WHY PEOPLE DO THINGS LIKE THIS.. yes, I know why; and I don't understand what thought process allows them to go ahead with such a short sighted measure. Why no plan to repair the leak.. still pouring their money out to drown and kill the people.. still pouring out the very thing that causes the revolt that leads to .. well want they want to do.. extort money... Its an ethical crime which leads to financial and criminal implications.. I am talking about the companies..

Its like watching two guys slug it out in a bar.. ignorant..Just my thoughts..
