Alanon
I don't really get the media outrage here. He didn't bog down the process with appeals, he didn't draft any politicians he might have in his pocket into putting pressure on the little guy to drop the case, he didn't try to get a sympathetic judge, he - as far as we know - didn't tamper with the jury. He came to court and the people let him go. Why is this a case of "rich and powerful guy getting away with murder"? If the media played this as another example of "inane jurors with double standards for celebrities", then I'd agree. I'm not seeing how his money is in play in this case, it's the fame. People really need to make up their minds. If Musk is a crazy maverick, then no one should take his obnoxious smirking self seriously, including when he calls people out or behaves stupidly. If he's a visionary, the next Steve Jobs or whatever, we should expect people to hang on his every word and then we can demand he take some responsibility. This weird limbo isn't working. Mocking him for the the low-poly truck, claiming he's unhinged because of the FCC disaster - and all of a sudden there's serious libel going on with a wilful, malicious disregard for the truth. That's just too far off. Now, there's no doubt that the nice man who saved the kids was damaged by his remarks. But that same man started the whole mess with the whole "he can stick the submarine" statement. In my opinion, the right thing to do would have been to reach an amicable settlement, by way of Musk showering the man with money and apologising profusely. That way the man at least wouldn't be as poor as the Guardian insists he is. The thing is, both of them wanted satisfaction, and Musk wouldn't budge, because he's a douche bag at heart. But that's not illegal, even if you're rich.
dhjohns
"Mr Musk's lawyers argued it was no more than a playground insult and did not represent a genuine allegation of paedophilia. The jury of five women and three men deliberated for less than an hour before finding in favour of Mr Musk." Sounds like a no-brainer to me. If I had a dollar for every insult I received, I would be a millionaire. Sometimes it is best to just let it go.
GRiM
23 hours ago, EnglishLionheart said: Another demonstration of money and power buying the law https://news.sky.com/story/elon-musk-not-liable-after-calling-british-caving-expert-a-pedo-guy-in-tweet-11880107 Utter Nonsense. Not everybody who has money and accused of a crime is guilty. I hope you never get to be in a jury. The money paid for his lawyers who correctly explained the law. Are you claiming he bribed the jury to win? Defamation didn't apply in context of his argument with the other guy. It was a throw away insult, not a genuine claim or they guy could have sued for libel instead. It annoys me nowadays just how many people are too lazy to look into a case but are perfectly willing to condemn somebody on basis of a few click bait headlines without context or research beyond quick glance. In arguments people naturally say none serious throw away insults that are not taken seriously. In this context it's not defamation. Now if he had claimed he was a paedophile in a separate and matter of fact way the other guy would have had a very strong case for libel and Elon would have had to give evidence for his claim or face monetary damages. That was not the case and this case should have never gone to trial. It was a waste of time and Elon should counter sue the other guy for being a pussy and wasting his time. Imagine if the guy won this case? Millions of people would face rediculous lawsuits and be in a panic trying to locate all their decades of internet arguments to delete all the times they told a guy he was a fat cunt living in his moms basement. Now a real example of defamtion by somebody is the fiasco with that Leaving Neverland mockumentary that is cleverly designed, edited and acted but when you actually look intp the characters and claims or their reasons it open your eyes just how fake and fraudulent they and the director are. There is a big reason why director only did their side of a fake story and that the the things that can be checked like dates, buildings and other aspects prove they're lying. They however can't get sued for slander or defamation because the accused is dead. They tried suing the Estate and lost spectacular only to try at making a cash grabbing movie and interviews to appeal to gullible people with emotion knowing they would just accept it without looking into the facts that dispute their claims as well as show multiple clear motives and collaboration. Just to clarify, I'm not saying MJ was innocent of all accusers claims I'm only saying that case was a clear example of fraud. By the way, you still dabbling in bestiality or you given it up? Matrix
Elon Musk wins defamation case against "pedo guy" In a nutshell: The jury has ruled that Elon Musk is not liable for damages after calling Vernon Unsworth, a cave diver involved in the rescue of a soccer team in Thailand, a “pedo guy.” Musk’s defense was that his hastily deleted tweet was only meant to insult Unsworth, rather than damage his reputation. Walking out of court, Musk told reporters, “my faith in humanity is restored.” In July 2018, when twelve boys and their coach were trapped in a flooded cave system, Unsworth was planning a rescue attempt with Thai divers while Elon Musk began constructing a miniature submarine designed for extraction. Fortunately, the divers were able to rescue the boys and Musk’s plan B wasn’t required. A few days later, however, in an interview with CNN Unsworth said the sub “had absolutely no chance of working” because Musk “had no concept of what the cave passage was like.” He claimed it was only a publicity stunt and told Musk to “stick his sub where it hurt.” The submarine being tested in a Los Angeles swimming pool. Musk bit back on Twitter saying “we will make [a video] of the mini-sub/pod going all the way to Cave 5 no problem. Sorry pedo guy, you really did ask for it.” And a month later, Musk tweeted “you don’t think it’s strange he hasn’t sued me?” …and Unsworth initiated the proceedings to sue him. (Who was asking for it then, huh?) Unsworth’s lawyer asked for $5 million in damages, $35 million in assumed damages and $150 million in punitive damages, a “hard slap on the wrist” for billionaire Elon Musk. Unsworth claimed Musk’s statements had ruined his reputation and caused him “shame, mortification, worry, and distress.” Musk argued that the tweets were “obviously a very off the cuff response” and by deleting them and apologizing for them, he had made it clear he was not making an accusation against Unsworth, who he never actually mentioned by name. “I knew he didn’t mean to sodomize me with a submarine, just as I didn’t literally mean he was a pedophile.” Source
