Italian prosecutors demand stiff sentences in Google Video case

Just a day after Google got into legal hot water in Germany, it emerged that four of the firm's executives standing trial in Italy could face a year's prison sentence following charges of defamation and failure to exercise control over personal data.

Defence lawyer Giuseppe Bana reportedly said that prosecutors had asked Judge Oscar Magni for one-year sentences, after allowing a clip to be posted on Google Video in Italy showing a boy with Down's Syndrome being bullied by four classmates.

European Union legislation states that internet service providers (ISPs) are not responsible for monitoring third-party content on their sites, but must remove such content if they receive complaints.

Google removed the video within 24 hours of receiving two complaints, but Italian prosecutors have argued that the search company is an internet content provider, rather than an ISP, and is therefore in breach of the same Italian law that regulates newspaper and television publishers.

The case follows a two-year investigation by Italian authorities. The maximum jail sentence for such charges is three years if convicted.

The Google executives involved are chief legal officer David Drummund, global privacy counsel Peter Fleischer, former chief financial officer George Reyes and former Google Video European director Arvind Desikan.

IMO, Google is not at fault.

They can't monitor millions of files uploaded everyday.

Agreed, they're only doing it for the fame and the money..

No, I don't really think they are either and I think that people should see and talk about behavior of this kind.. People need to deal with that side of themselves. But you know I can remember seeing and watching videos online of captured traitors of the Taliban.. having their throats cut in real time.. guy trying to scream the whole way through and watching him bleed out..Took their time about it too.. Thats real murder.. I don't see anyone saying anything about that..

this is bullshit.

it's a good thing that a video like this gets uploaded.

if it hadn't been uploaded, these kids might get away with it, but now they are filming their own crimes... evidence that is used against them.

I have seen such videos also... terrorists beheading people. There is also a site dedicated to shocking and disturbing things.. but I will not post it here (who is interested, PM me).

People responsible for making sites that show "shocking and disturbing" videos such as murder should themselves be raped and beheaded so that sick @#$%s stop getting paid to share that @#$%.

NO reason at all for such videos to exist, let alone be profited upon.

It's not Google's fault. You just can't moderate thousands of videos in just a few seconds after they were posted, can't you?
