Microsoft is being sued for infringing a patent of SurfCast, an operating system technology design that claims to have thought of the concept of "Live Tiles" in October 2000.

Microsoft is facing a lawsuit from SurfCast, an operating system technology designer who filed a complaint yesterday in the U.S. District Court in Maine. The filing says that Microsoft infringes one its four patents, by "making, using, selling, and offering to sell devices and software products" covered by SurfCast's patent. This includes mobile devices using Windows Phone 7, Windows Phone 8, as well as Windows 8/RT devices, including the newly launched Surface tablet. The company has also added that Microsoft is contributing to infringement by encouraging developers to make apps tiles.

SurfCast claims that Microsoft has both directly and indirectly infringed on its patent and wants Microsoft to "account for and pay to SurfCast all damages caused to SurfCast by reason of Microsoft's patent infringement". On SurfCast's website the company says that they designed the "new concept" and filed for the patent related to "Tiles" in October 2000, with it being issued to them in April 2004. In the complaint SurfCast claims that Microsoft had knowledge of the 403 patent at least as early as April 21, 2009.

Maine firm sues Microsoft over Windows 8 elements

PORTLAND, Maine  -- A small technology company based in Portland, Maine, has filed a patent infringement lawsuit against Microsoft over elements included in Windows 8.

SurfCast Inc. filed the complaint Tuesday in U.S. District Court in Portland asking for unspecified damages.

The lawsuit claims Redmond, Wash.-based Microsoft Corp. is using elements known as live tiles, rectangular icons linked to websites, apps and other items. SurfCast says it developed the elements in the 1990s.

The lawsuit claims Microsoft is using the tiles technology on operating systems including the recently launched Windows 8, found on personal computers, phones, tablets and other devices.

Microsoft says it's confident it can prove the claims are without merit.

i thought of many things. but since i didnt go through with them i know i shouldnt patent thought without a actually product.

another totally bs patent lawsuit.

Yea whatever ... every now and then a dwarf tries to bit the giant .. it won't hurt!

True. But the giant also loves to bully the dwarfs. As in, MS is also a patent troll, a big one, one of the top three, but rather than going to court for it's patents, it prefers to settle it by dealing with money, which I think is great, but being patent troll is bad anway.
