Apple has a reason to celebrate today after having won a preliminary injunction to stop sales of the Samsung Galaxy 10.1 in the US. Samsung on the other hand disagrees and have already appealed.

Today Apple has won a preliminary injunction against sales of the Galaxy Tab 10.1 in the United States. Samsung has already appealed against the decision though.

Samsung hasn't had it easy launching much of their Galaxy line of hardware, what with the 10.1 tab having a rocky start in Australia where it was banned, unbanned and then banned again before eventually being cleared for sale. Apple is also seeking to get the Galaxy S3 banned in the US as well.

The same story in Europe too including Germany, which only four months ago allowed a 10.1N revision of the device to finally be sold in the country.

The Verge is reporting that US District Judge Lucy Koh blocked sales adding "While Samsung will certainly suffer lost sales from the issuance of an injunction, the hardship to Apple of having to directly compete with Samsung’s infringing products outweighs Samsung’s harm in light of the previous findings by the Court."

Samsung responded pointing out the damage it would do to agreements made with wireless carriers, but Koh disagreed stating: "Samsung cannot be heard to complain about broken business relationships that it has established on infringing products."

Apple has agreed to submit a bond of $2.6M in-case Samsung successfully prove they aren't infringing Apple's D'889 design patent, and to subsequently compensate for their losses. The appeal documents can be found here.
