BREIN Orders Shutdown of Generic 'Piratenpartij' Proxy

As predicted in my previous article, BREIN has 'ordered' the Dutch Pirate Party ('Piratenpartij') to take their generic proxy service (located at http://proxy.piratenpartij.nl/) offline.

Previously BREIN managed to persuade the judge into providing them with an ex parte (no defense, based on similarity to previous cases) order to have the Piratenpartij disable their TPB proxy (http://tpb.piratenpartij.org/). However in addition to providing a specific TPB proxy the Piratenpartij also provided a generic proxy, which can be used to visit any website (including, still, TPB).

After the Piratenpartij was ordered to disable their specific TPB proxy they replaced the page with a new page which stated the futility of the court order, pointing at the fact that their generic proxy was still only and that there are many other proxy services. BREIN has now 'ordered' the Piratenpartij to start blocking The Pirate Bay even on their generic proxy before 12:00 (GMT+1, summer time) today. Needless to say the Piratenpartij did not comply with this 'order' because the ex parte order includes no clauses about a generic proxy.

It is to be expected that BREIN will try to get another ex parte judgement from the same judge, but due to the generic nature of their proxy (which sets it apart from the previously mentioned specific proxy) it is unlikely that the judge will use the previous case to base his/her decision on yet again. Hence it is likely that BREIN will sue the Piratenpartij again, more updates will follow ;)

If the Pirate Bay really wants to live forever, why don't they create a desktop client of The Pirate Bay? It can include a full magnet search engine and on top of that, there can be options to use VPN services and Tor encryption. They could make it open source and encourage developers to make BETTER versions with even more functions. The possibilities could be endless.
