When i saw this the first time i was devastated. The elderly man approached the police in a non aggressive manner. Then suddenly the cops just shoved him, causing him to fall backward; his head ended up slamming the pavement. As a result of that fall i saw immediate pool of blood just under his head. Last report i heard he was in critical condition.

 

I hope and pray for his recovery and well being.

Rules are rules and yes they can change anytime that's the roll of Admin and if you have a problem then your free to discuss this with them.

Buffalo mayor calls elderly protester shoved by police an ‘agitator’

 

The elderly Buffalo protester knocked to the ground by cops in a viral video that has become an international symbol of police brutality was an “agitator” who was “trying to spark up the crowd of people,” the city’s mayor said.

 

Explaining why he had yet to fire the officers seen pushing Martin Gugino, 75, to the ground, where he hit his head and bled onto the pavement, Mayor Byron Brown said, “I don’t want to jump ahead of the investigation. It is very important for officers to know they are getting due process,” according to WBEN Radio.

 

Brown referenced violence, vandalism, looting and fires being set during protests in the city, then described Gugino as “a key and major instigator of people engaging in those activities” in remarks he made Friday.

 

“He was in the area after the curfew. One of the things that happened before was conflict among protesters and there was a danger of fights breaking out, and police felt it was important to clear that scene for the safety of protesters,” said Brown.

 

State Police will be brought in to assist Buffalo after 57 cops, the department’s entire Emergency Response Team, resigned in solidarity with the two officers who were suspended over the altercation with Gugino, the mayor said.

 

“Our residents in every section in the city of Buffalo will be protected,” Brown said, vowing police would also protect “everyone who is peacefully protesting.”

 

Gugino is recovering in the hospital.

BUFFALO, N.Y. — Two Buffalo police officers were charged with assault Saturday, prosecutors said, after a video showed them shoving a 75-year-old protester in recent demonstrations over the death of George Floyd.

 

Robert McCabe and Aaron Torgalski, who surrendered Saturday morning, pleaded not guilty to second-degree assault. They were released without bail.

 

McCabe, 32, and Torgalski, 39, “crossed a line” when they shoved the man down hard enough for him to crack his head on the ground, Erie County District Attorney John Flynn said at a news conference, calling the victim "a harmless 75-year-old man.”

 

The officers had been suspended without pay Friday after a TV crew captured the confrontation the night before near the end of protests. If convicted of the felony assault charge, they face up to seven years in prison.

 

Phone messages were left on Saturday with their lawyers.

 

The footage shows the man, identified as longtime activist Martin Gugino, approaching a line of helmeted officers holding batons as they clear demonstrators from Niagara Square around the time of an 8 p.m. curfew.

 

Two officers push Gugino backward, and he hits his head on the pavement. Blood spills as officers walk past. One officer leans down to check on the injured man before another officer urges the colleague to keep walking.

 

The police officers “knew this was bad,” Flynn said of the video. “Look at their body language.”

 

The video of the encounter sparked outrage online as demonstrators take to cities across the country to protest racial injustice sparked by the death of George Floyd, a black man who died after a white police officer pressed a knee into his neck for several minutes.

 

“I think there was criminal liability from what I saw on the video,” Gov. Andrew Cuomo said at a briefing Saturday. “I think what the mayor did and the district attorney did was right, and I applaud them for acting as quickly as they did.”

 

“What we saw was horrendous and disgusting, and I believe, illegal,” he added.

 

But dozens of Buffalo police officers who were angered over their fellow officers’ suspensions stepped down from the department’s crowd control unit Friday. The resigning officers did not leave their jobs altogether.

 

Several off-duty officers gathered on Saturday outside the courthouse in a show of support for the accused officers. Flynn said he understood their concern and pointed out that he’s also prosecuting protesters “who have turned into agitators” and “need to be dealt with as well.”

 

“There will be some who say that I’m choosing sides here,” he said. “And I say that’s ridiculous. I’m not on anyone’s side.”

I am not anti police. but police brutality is a problem and needs to be solved. They (police) should use force only when appropriate and the force used should be proportionate. There is a saying: "don't push, when there is no resistance, you will only fall flat on your face.

Two Buffalo, New York, police officers are now facing criminal charges in connection with the graphic caught-on-video shove of a 75-year-old man during a protest, prosecutors said.

 

Officers Aaron Torgalski and Robert McCabe were charged with second-degree assault during their video arraignments on Saturday and were released on their own recognizance. They both entered not guilty pleas and are expected back in court on July 20.

 

The Thursday protest at Niagara Square had less than 20 demonstrators and several members of Buffalo Police Department's Emergency Response Team, officials said.

 

One of the protesters, Martin Gugino was seen on video walking in the direction of the crowd of uniformed officers when Torgalski and McCabe are accused of shoved him.

Gugino fell flat onto his back and bumped the back of his head on the concrete, video shows. The sound of the man's head hitting the ground silenced the crowd, according to the video. 

 

A trail of blood can be seen seeping from the head of the motionless man as several officers walked by him.

"Mr. Gugino has been a longtime peaceful protester, human rights advocate, and overall fan of the U.S. Constitution for many years. At this time, Mr. Gugino is in serious but stable condition. He is alert and oriented," said Kelly V. Zarcone, Gugino's attorney, in a statement.

 

Another officer, possibly a National Guard member, who went to aid the bleeding man was pushed by fellow officers, the video shows.

 

Governor Andrew Cuomo said at a press conference on Saturday that the video was “horrendous, disgusting” and said he believed it to be illegal. "A bad police officer is an enemy of every good police officer," Cuomo said.

 

The spokesperson for the city and police department, Mike DeGeorge, initially said in a statement that the man "tripped and fell."

 

"Once the department became aware of additional video from the scene, they immediately opened an investigation," DeGeorge told ABC News on Thursday.

The police union opposed the suspensions and in response 57 officers on the emergency team resigned from their positions, but will remain on the force.

I watched the footprint, what the policemen did  wasn't necessary in any way

@cosy i agree completely. Whats disturbing is the impact thud from the old man falling and bumping his head can be heard on the opposite end of police line. Hence, why they all turned immediately to see what that sound was.

 

I don't post this stuff to be sadistic, but to raise awareness that this crap is happening all over the world. Police using violence on people that pay their salaries.
