Apple wins appeal in earbud hearing-loss lawsuit

Apple iPod earbuds cannot be held responsible for hearing loss, according to a Reuters report.

Just because something can benefit from some improvement doesn't mean that it's necessarily bad for you. That's basically what a San Francisco appeals court said when it upheld a previous ruling that

In the ruling, a judge wrote that the plaintiffs didn't offer evidence to show that iPod earbuds were dangerous, only that they believed they could be made safer. The judge wrote:

The plaintiffs do not allege the iPods failed to do anything they were designed to do nor do they allege that they, or any others, have suffered or are substantially certain to suffer inevitable hearing loss or other injury from iPod use. At most, the plaintiffs plead a potential risk of hearing loss not to themselves, but to other unidentified iPod users.

In addition to money damages, the suit wanted a judge to require that Apple improve and provide better earphones, offer disclosures, and test iPod users for hearing loss.

In the United States, there are just too many silly lawsuits such as this one. Some people on buses and subways play their iPods so loudly that you can easily hear their music from quite a distance. These people should know better and not expect Apple to give them money for their hearing loss.

Well I've read many reports sayin that people goin deaf but that's because as Night Owl mentioned, too loud voice/sound from their mp3 players. I personally like to hear my iPod in a quite environment and at a low voice/sound. :listen::stereo:

But hey, you cannot blame apple's earbuds for goin deaf but you can blame it for it's quality. :P

No see you could sue your self for playing certain frequency ranges and turning it up too loud.. then sue impedance level of the sound coming from the low-quality ear-buds.. WITH NO BASS.. Then sue yourself again for not knowing how to run a mixer and/or an equalizer.

They should stand on the train tracks for buying an ipod to begin with. Every clown wants an ipod these days to fit into the "cool" crowd, drones with no thinking of their own I call it, just moving with the mass hysteria. Ipod has the crappiest earbuds on the planet and they retail them for $50US and fools with no idea what is real sound quality go and buy it. You are right, ipod earbuds have no bass whatsoever, cheaply produced and pathetic frequency response. What's the point in listening to your music on ipod earbuds if you only hear half of the sound? Apple uses crap DSP chips too so they are just fooling people who don't know better. If anyone is interested, head-fi.org will teach you about real audio equipment.

Well to be honest what I do recommend is that people buy real earbuds like Denon or Sennheiser or Sony but the first 2 are superior. When you hear what you were missing out on all this time you would really be amazed. No need to go too audiophile, but a little bit audiophile is good enough to hear the full spectrum of the music.
