hanged by the neck until.........

I was just watching an old western. In the movie a man is on trial for murder. The prosecuting attorney says, "I will demand that he be hanged by the neck until dead". It hit me as funny. I mean do they ever say anything else? Is there an alternative to being hanged by the neck until dead? Like was anyone ever just "hanged by the neck until pissed off"? hehehehehe :D

"until dead" or "until death" serves as clarification. Double jeopardy doesn't include carrying out a sentence.
If the rope breaks during the hanging, that doesn't mean the condemned is allowed to go free.

The condemned's reprieve lasts only as long as it takes to correct the problem or schedule another date for execution.
The executioner can hang the person again, as many times as it takes until he or she dies.

Sometimes they flailed around for 5 to 10 minutes, that's why the sentence was worded the way it was. Dropping was suppose to break their neck, but sometimes they chocked to death slowly. Other times their heads would pop off.

Some argue that subjecting the condemned to further execution attempts, after the first one has failed, constitutes cruel and unusual punishment.

It may just be a Hollywood thing. But it would have been possible for someone to be hanged and have the rope break. And in some places it might have been arguable that the person was "hanged" and it was divine intervention so they should go free. So the sentence being read that way makes sure that the intent is for them to be dead at the end, period. Otherwise you could seriously argue the person was just supposed to hang by the neck for a couple minutes to suffer pain as punishment, and then they get to walk off.
