beer Posted December 13, 2011 Share Posted December 13, 2011 Today's Headline:Indefinite Military Detention: Revised Defense Bill Still Gives President Authority To Lock Up CitizensWhat I have gathered skimming through the article is that even though the bill has been revised, there are still much grey area that grants the US president absolute power to detain anyone he claims to be related to terrorists.Opponents argued that although agencies like the FBI would still be allowed to investigate in theory, the compromise could prove unworkable in practice. They questioned how civilian authorities will work with their military counterparts, who could take over any terror-related case unless the president grants a waiver.Proponents have argued that the bill is designed is to spell out what is already being done so that there is less uncertainty surrounding counterterrorism efforts. They say that the military needs clear authority to ensure that the ever-changing terrorist threat can be met. Sen. Lindsey Graham (R-S.C.) declared as the Senate passed its version that the bill affirms that "the homeland is part of the battlefield."The legislation is likely to pass the Senate and the House this week.Sacrifices needs to be made to fight terrorism, but at what cost? This defense bill contradicts the 5th Amendment of the US constitution that is suppose to protect the American people from government abuse of power.No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
